1.General
Proven Products Marketing Ltd
are suppliers of mainly non-standard items. This means that, by their very
nature, the parts we supply may not be a straightforward DIY fit. In some
cases, modifications or adaptions may be required to achieve an acceptable
fit. It is for that reason that we always recommend that our parts should be
fitted by a suitably qualified person.
2. V.A.T.
Our prices clearly indicate
whether VAT is included or not. VAT at the current rate is payable on all
goods delivered to the UK & the EU. In the case of EU VAT registered
traders, this may be exempted subject to us having sight of the relevant
documents. For shipments outside the EU, the VAT may be exempted providing we
ship the goods abroad by a recognized shipper.
3. Prices.
Our prices are subject to
alteration (up or down) without prior notification, we advise that whether you
are placing your order by telephone, email, fax, mail or any other means, that
you should check the current prices with our sales office first. Remember that
any prices shown in magazines could well be out of date, said magazines are
often kept for a long time! Sometimes we may make a pricing error (yes
really!), in that instance we retain the right to charge the correct price,
sometimes you may see items that have no prices listed or are priced as
£00..00, they are not free, the price has simply not been added yet! Note that
as we are only human we sometimes make mistakes in email & phone pricing & we
reserve the right to correct these, we will always inform you of any changes
before going ahead with your order
4. Deliveries.
Delivery charges where shown on
our website or in our adverts are for guidance only, we recommend that you
check the charges with our sales office prior to placing your order. This
particularly applies to items sent to addresses outside the UK mainland as we
will need to weigh the items concerned. Wherever we quote delivery times,
please be aware that we cannot be held responsible for late delivery, we will
always do our best to ensure that the customer receives the goods when
expected, but sometimes things do go wrong! We recommend that you don't make
any specific arrangements to have parts fitted until they have arrived. Please
note that under no circumstances will any carriage charges be refunded for
items that have been sent outside of the UK mainland.
5. Loss/Damage in Transit &
shortages.
We make all efforts to ensure
that all goods that leave our warehouse are securely packaged to minimize any
possible damage in transit. Once you or the person receiving the goods has
signed for them as being received in "good condition" we may not be
able to make a claim from the couriers. We suggest that if you are in any
doubt about the condition of the package, that it be signed for as "not
checked", or if it is obviously damaged or opened as "received
damaged". In any case you should inspect the goods as soon as possible
after receipt, notifying our sales office immediately if there appears to be a
problem. Written confirmation within 72 hours would also be a help.
6. Returns.
Excluding items damaged or lost
in transit which are dealt with in clause 5, or those under warranty which are
dealt with in clause 7, goods for return must be notified to us in writing
within 7 days of receipt. Please contact us in the meantime to obtain a
returns number which must be clearly shown on the returned parcel. The cost of
returning the goods safely to us is your responsibility & they must be
securely packed & insured, we may in some cases be able to arrange for collection but
the cost of this will be your responsibility, the fact that said goods have
been collected does not guarantee that they were securely packaged for return.
We may not be able to accept back non-faulty goods that have been supplied to
your specific order or damaged during return transit or fitting, the goods
must be returned to us in saleable condition. Goods correctly supplied against
information supplied by you or returned outside the 7 day period previously
mentioned may be subject to a minimum 15% handling charge, some special order
items correctly supplied may not be returnable depending on the manufacturers
policy on returns. If you accept a credit note or exchange the goods for
others the handling charge may in some cases be waived. Refunds are normally
made within 30 days in the same manner as the original payment, i.e. visa etc.
Note that any goods returned must be in saleable condition, unmarked & in
their original packaging.
7. Warranty Claims.
Where a product has a
manufacturers warranty, any item returned under that warranty may need to be
returned, carriage paid directly to the manufacturer or in some cases to
ourselves for inspection. Please contact our sale office for relevant
information. Under no circumstances will Proven Products Marketing Ltd accept
responsibility for any labour & associated costs involved with any
warranty claim.
8. Statutory Rights.
Your statutory rights under
current English legislation are not affected. All orders are subject to
current English legislation.
